Legal Aid Eligibility changes
Legal Aid Eligibility changes:
These changes are intended to allow more people to access justice in civil cases law.

Mortgage cap removal:
The change in legislation removes the existing cap on the amount of mortgage debt that can be deducted from a property’s value, so that all mortgage debt will be deducted.
This means that more individuals will pass the financial eligibility criteria for civil legal aid. This change came into effect on 28 January 2021.

If you think this change to Legal Aid will enable you to access Legal Aid where it may not have been previously possible, due to owning a property, then please contact our Family Department to discuss this further and seek an assessment for Legal Aid.
